NO FREE FOR DRUG DEALER
"The president will not give clemency to drug dealers. Agreed?" Jokowi asked.
"Agreed!" responsibility of the student.
That piece of dialogue between President Joko Widodo with high school students (high school), at the Presidential Palace, on Monday (02/03/2015) ago. Jokowi statement again confirms that there is no compromise for the convicted drug.
At the beginning of his reign, Jokowi 64 states refused clemency petition filed by the death row drug cases. Reasons for refusal of pardon, said Jokowi, to provide shock therapy. According to him, government action to execute the death row case of drugs to provide a deterrent effect for the ports of drugs that are still in operation. Jokowi mention, day 50 people died because of drugs.
He considered, this condition makes Indonesia in emergency drugs. Is this correct?
Deputy Director of the Human Rights Working Group (HRWG) Choirul Anam said research data on the impact of drug trafficking that is not valid. According to Choirul, none of the studies showed that the death penalty is effective in reducing drug trafficking. Instead of combating drugs, Choirul said the decision to continue to implement the death penalty proved that the government has been unable to overcome the drug problem.
"There is unfounded if the reason has been tested by experts who examined. If it is an emergency, there should be measures of government, instead of executing the offender. It even shows the failure of the government," said Choirul to Kompas.com, Sunday (15/3 / 2015).
At the same time, further Choirul, when the activists and human rights activists claim the promise Jokowi to resolve severe cases of past human rights, such as the case of the murder of human rights activist Munir, and the case of mass murder in the event Talangsari, Jokowi even flinch. The choice is rejected clemency and execute death row inmates deemed also to have violated human rights.
Meanwhile, the coordinator of the Commission for Missing Persons and Victims of Violence (Contrast) Haris Azhar rate, leadership Jokowi no different from previous leaders, hkususnya in upholding human rights issues. Haris confessed pessimist Jokowi can show decisiveness.
"Jokowi should learn humanitarian trends. Enforcement of Human Rights no way. Nonsense law enforcement, if corruption and the death penalty is justified," said Haris.
Can not sweep
Haris deplores Jokowi who refused to give clemency for death row narcotics cases. According to him, judging a clemency petition, can not be decided arbitrarily by the President. He said many things to consider in deciding an appeal for clemency.
"Denial of Clemency can not mop. There is a case by case basis to be aware of," said Haris.
Among the many death row inmates, according to Harris, there are two that are considered most need attention about clemency. They are citizens of the Philippines, Mary Jane Fiesta Veloso, and citizens of Brazil, Rodrigo Gularte.
Harris explained, Mary Jane was previously a domestic worker woman who used her employer as drug couriers. While Rodrigo, called Haris, psychiatric disorders, so according to the rules of law, he can not be convicted, let alone executed.
Rejection
Executions also lead to rejection of the countries whose citizens in the waiting list execution. Australia is one country that is struggling to seek two citizens who are awaiting execution. Various maneuvers performed, ranging from threatening to boycott tourists, exchange of prisoners, to give an offer to pay the cost of living two death row inmates. However, all these efforts seem futile.
Some analysts believe, the death penalty is proof of the rule of law in Indonesia. Thus, the decision should not be interfered with by anyone.
Chairman Equivalents Institute Hendardi judge rejecting the request for clemency by President Joko Widodo, is an attempt to cover up weaknesses in the field of law enforcement. Hendardi said, Jokowi trying to show off decisiveness, at the time of his authority slumped in isntitusi problems between the two law enforcement, the Commission and the Police.
"Supposedly, the death penalty in clear violation of human rights is not an option only for Jokowi. This is not in accordance with his promise to guarantee human rights," said Hendardi.
The priest Franz Magnis Suseno say, weak legal system in Indonesia is not supporting the enactment of the death penalty. According to Franz, the number of court decisions are still in doubt, indicating that the legal system in Indonesia can not guarantee a litigant will get justice.
Franz urged the government to carry out a policy to cancel the execution of death row cases of narcotics. Frans said the government should issue a moratorium to stop the death penalty.
Government budge. HM Attorney General Prasetyo ensure the execution will be carried out in the near future. Attorney has released ten names on death row that will be executed in reclaiming.
